HMRC is consulting on Draft Indirect Taxes (Notifiable Arrangements) (Amendment) Regulations 2023. The draft regulations will amend the descriptions of various tax avoidance arrangements in the principal regulations (the Indirect Taxes (Notifiable Arrangements) Regulations, SI 2017/1216) in relation to which disclosure requirements apply, to make sure those requirements also apply in relation to supplies between VAT group members. As things stand currently, intra-group supplies which are disregarded for VAT purposes consequently also fall outside the disclosure rules. The changes will apply to regs 5 and 6 of the principal regulations, covering hallmarked arrangements relating to offshore supplies.
