The appellant purchased a Lamborghini Murcielago and sought to reclaim the input tax on the ground that it would be used solely for business purposes. The car had been set up for track use only and could not be used on public roads. At the hearing HMRC accepted the appellant's evidence to that effect and the appeal was allowed.
