Research briefing on loan charge

The House of Commons library has published a research briefing on the 2019 loan charge covering the introduction of the legislation, its consideration by the House of Commons and the debate as to whether HMRC’s approach has been fair or not, including:

  • the legal challenge to the operation of disguised remuneration loan schemes (the Supreme Court decision in Rangers [2017] STC 1556);
  • HMRC’s actions to tackle the marketing of schemes by scheme promoters;
  • concerns as to the retrospective nature of the loan charge; and
  • the operation of HMRC’s settlement opportunity for scheme users who wished to avoid paying the charge.

The briefing concludes by looking at developments that followed the introduction of the loan charge in April 2019, and the series of changes the government announced in December 2019 in response to the independent review by Sir Amyas Morse.
