The Customs Tariff (Establishment and Suspension of Import Duty) (EU Exit) (Amendment) Regulations, SI 2021/63, make changes to the definition of ‘tariff of the United Kingdom’ in the Customs Tariff (Establishment) (EU Exit) Regulations, SI 2020/1430, to refer to a revised United Kingdom tariff document. This document is updated to ensure that goods that are subject to trade remedies based on an injury margin will continue to face the same tariff rate that was applied before 1 January 2021.

The regulations also replace the definition of ‘suspensions of import duty rates document’ in the Customs Tariff (Suspension of Import Duty Rates) (EU Exit) Regulations, SI 2020/1435. to refer to a revised tariff suspension document. This document is updated to remove 12 products listed that are subject to injury-margin based trade remedies, which supersede duty suspensions, to ensure continuation of the same level of protection as during the implementation period. The regulations came into force on 22 January 2021.
