Earlier this year the Government published the Serious Crime Bill 20071 in an effort to rationalise and improve the criminal law system. The Bill is reaching the final stages of its statutory path and should be ready before the start of the next financial year.
 
One of its implications will be that the prosecuting arm of HMRC Revenue and Customs Prosecutions (RCPO) will have a new power (currently the exclusive preserve of the soon to-be abolished Assets Recovery Agency (ARA)2) to recover property it suspects to be of criminal origin in civil proceedings without the need for anyone to be convicted...
