Paternity leave changes finalised

The Paternity Leave (Amendment) Regulations, SI 2024/329, provide the necessary revisions to paternity leave rules, to fulfil the following policy changes from 6 April 2024:

  • statutory paternity pay (SPP) will be available for two, non-consecutive weeks of statutory paternity leave while the existing option of taking all the leave in a single block will remain;
  • SPP will be available where statutory paternity leave is taken at any time in the first year after the child’s birth or placement for adoption (extended from the current first eight weeks); and
  • the notice period for SPP will be reduced to four weeks in most cases (different dates apply for domestic adoption cases).

These regulations are part of a package of legislative measures to provide greater flexibility for paid paternity leave from April 2024. The leave and pay elements of statutory payments are dealt with separately in the legislation. While these regulations cover the leave element, the Statutory Paternity Pay (Amendment), SI 2024/121, made the necessary changes for the purposes of SPP.
