The CIOT has highlighted an effective exemption for certain small employers from the obligation to file PAYE annual returns online.

'Employers must file employer annual returns by 19 May 2010 online to avoid penalties. However employers with five or fewer employees can for 2009/10 only file the return on paper without incurring a fine ' the tax body said. Almost all employers must file the returns P35 and P14 online and failure to do so will result in a penalty notice being issued.

There are some limited exceptions. Although employers with five or fewer employees are required to file online unless one of those exceptions applies the penalty for such employers failing to do so is 'nil' for 2009/10...
