Under Part 6 of POCA 2002 the Director of the Assets Recovery Agency (the Director) is able to assume nearly all of the taxation functions of the Officers of Her Majesty's Revenue and Customs in order to recover the proceeds of crime. She may only do so if certain conditions are satisfied and in the event the Director has recognised that other powers under the Act are not appropriate such as confiscation of property which can only follow a conviction or civil recovery proceedings under Part V.1
