In the long awaited decision in Venables and the Trustees of the Fussell Pension Scheme v Hornby[2003] UKHL 65 (the Venables case) the House of Lords has reversed by a majority of 4 to 1 the previous Court of Appeal decision this time finally in favour of Mr Venables. So the vexed question of what constitutes early retirement for a director has finally been resolved after eight years.
