HMRC has updated its guidance Manage your trust’s details to cover the situation where trustees of a trust which has not been registered first need to ‘claim’ the trust before authorising an agent. The ATT has also updated its step-by-step guide How to update the trust register to reinstate the step for trustees to claim the trust and authorise an agent. The ATT notes that HMRC had been unable to remove the step requiring a trustee to ‘claim’ their trust and that HMRC acknowledges that, although omitting that step would make the process of appointing an agent to manage a trust registration easier, ‘it is an important security step which needs to remain in place’.
