SRA issues warning on SLAPPs

printer Mail

The Solicitors Regulation Authority has advised members to ‘guard against getting involved in abusive litigation aimed at silencing legitimate critics, known as strategic lawsuits against public participation (SLAPPs)’.

The SRA’s warning notice tells law firms not to act for clients in this way and to ensure that any proceedings are pursued correctly. As the SRA notes: ‘Examples of abusive conduct or misuse of the legal system include bringing cases or allegations without merit, making unduly aggressive and intimidating threats, or claiming misleading outcomes such as exaggerated cost consequences or imprisonment in a civil claim.’

Tax Policy Associates contrasts the new SRA guidance with correspondence its director, Dan Neidle, received from former Chancellor Zahawi’s lawyers following allegations published by TPA surrounding Mr Zahawi’s tax affairs.
