New HMRC guidance

HMRC has published the following:

  • Money laundering enforcement measures: updated to clarify when HMRC may issue penalties directly to officers of the business (para 4.28), impose civil penalties for breaches of ‘fit and proper’ rules (para 5.8), and publish details of businesses issued with penalty notices (para 5.12);
  • Requirement to correct: factsheet on the new requirement for UK taxpayers to make sure that all their foreign income and assets, where there might be tax to pay, have been correctly declared to HMRC before 30 September 2018;
  • Pension schemes newsletter 95: includes articles on Scottish income tax and relief at source, updating scheme administrator details in pensions online service, outstanding ‘accounting for tax’ charges, HMRC information powers for pension schemes, and reporting non-taxable death benefits;
  • Residence, domicile and the remittance basis (RDR1): updates the June 2016 version to reflect changes to the deemed domicile rules which took effect from 6 April 2017, with the main changes in new section 5.21 (deemed domicile) and section 9.32 (remittance basis charge);
  • Deemed domicile rule changes: overview of the new rules on deemed domicile, introduced by Finance (No 2) Act 2017, affecting the remittance basis for income tax and CGT with effect from 6 April 2017;
  • Remittance basis changes: guide to changes affecting the remittance basis from April 2017, following the new deemed domicile rules introduced by Finance (No 2) Act 2017;
  • Mixed funds cleansing rules: overview of changes to the conditions for cleansing overseas mixed funds accounts from April 2017, following the new deemed domicile rules introduced by Finance (No 2) Act 2017;
  • Business investment relief: overview of changes to business investment relief for non-domiciled individuals from 6 April 2017, following the new deemed domicile rules introduced by Finance (No 2) Act 2017; and
  • IHT on enveloped UK residential property and relevant loans: overview of the new rules introduced by Finance (No 2) Act 2017 bringing certain UK residential property held by non-domiciled individuals through overseas vehicles into the scope of IHT with effect from 6 April 2017.
