HMRC has added new spotlight 43 on the misleading advertising of an SDLT avoidance scheme involving the SDLT exemption for mortgage providers taking security interests.

The spotlight refers to an Advertising Standards Authority ruling on misleading claims made about SDLT schemes by their promoter, Fiducia Wealth and Tax. The promoter’s advertising failed to highlight that the SDLT scheme offered is a form of tax avoidance which HMRC is likely to challenge.
