ERS end of year returns guidance

printer Mail

HMRC have updated their guidance, How employment related securities work if you’re an employer, to add more detail on circumstances where an end of year return is not required. An ERS end of year return will not be required where all of the following criteria are met:

  • the company or any other company in the same group or under the same ownership is not registered for PAYE;
  • the arrangements are not tax-advantaged schemes (i.e. SIP, SAYE, CSOP or EMI);
  • the company has no obligations to operate PAYE in respect of the reportable event; and
  • the company has no obligation to operate PAYE in respect of anything else it does.

The guidance also includes a more general reminder that (outside of the above), if there are no reportable events, a nil return must be submitted. Of course, the 6 July deadline has just passed (HMRC’s Employment Related Securities Manual at ERSM140080 covers late-filing).
